Who can take supplemental maternity leave?
Supplemental maternity leave is granted to both the mother and the father raising the child (including the father raising the child and the father raising the child) after the basic maternity leave ends. The basic condition is timely termination of the basic maternity leave and a properly documented health condition of the child or mother – for example, due to premature birth or low birth weight of the child. However, it is important to remember that this type of leave can be used only once and cannot be divided into smaller parts.
Both the employee and the female employee have the right to apply for supplementary maternity leave under the same rules.
How long does supplemental maternity leave last?
Supplemental maternity leave is always rounded up to full weeks. In some cases, it is possible to take a shorter amount of leave, if the employee chooses to do so. This means that when, for example, the calculations show that the employee is entitled to 14 weeks and 2 days of leave, she is entitled to 15 full weeks. Determining the specific size of the leave takes into account, among other things, the length of the child’s stay in the hospital after delivery or information about the week of pregnancy when the child was born. Supplementary leave should be taken during the school year, according to the specific period set by the employer.
What should the application contain?
The application submitted by a female or male employee should contain all the required information and attachments. Don’t worry – the application we have prepared is very simple to fill out. All you need to include in it is your name, the end date of your basic maternity leave and the period during which you want to take supplementary maternity leave. Be sure to attach to the application also:
- A statement that the other parent of the child does not intend to use this leave,
- a relevant certificate from the hospital about the week in which the child was born, its birth weight or the duration of the child’s stay in the hospital,
If the request is made for unused leave due to incapacity, the employee is required to attach the appropriate medical certificate.

Application procedure
In order to obtain the granting of supplementary maternity leave, an appropriate application must be filed with the employer. The application for supplementary maternity leave should be submitted no later than 21 days before the end of the maternity leave. The document should indicate the period during which you plan to take supplementary maternity leave, and include the required statement from the employee that the other parent of the child does not intend to take this leave.
